By engaging with Ukuthula’s services, the Client acknowledges and agrees to the terms set out in this policy.
2. NO GUARANTEE OF RESULTS
Ukuthula Sales Solutions does not guarantee specific results, including but not limited to:
Lead generation volumes
Sales conversions
Revenue growth
Return on investment (ROI)
Business expansion or profitability
All services are delivered on a best-effort and professional basis, using proven strategies, systems, and industry knowledge.
3. PERFORMANCE COMMITMENT
Ukuthula commits to:
Applying industry best practices
Using proven marketing strategies and systems
Continuously optimizing campaigns and processes
Acting in the best interest of the Client’s business growth
We commit to delivering our highest level of effort, skill, and expertise at all times.
4. SHARED RESPONSIBILITY FOR RESULTS
The Client acknowledges that business success and marketing performance are shared responsibilities and depend on factors beyond Ukuthula’s control.
These include, but are not limited to:

Quality, pricing, and competitiveness of the product or service
Market demand and positioning
4.2 Customer Experience
Customer service quality
Speed of response to leads and inquiries
Sales processes and closing ability
4.3 Business Reputation
Google reviews and online ratings
Brand perception and trust
Previous customer experiences
4.4 Internal Operations
Staff performance and attitude
Operational efficiency
Ability to deliver and fulfill services
4.5 Client Participation
Timely communication and approvals
Willingness to implement recommendations
Accuracy of information provided
5. CLIENT ACCOUNTABILITY
The Client accepts full responsibility for:
Managing and converting leads generated
Maintaining high service standards
Delivering quality products or services
Ensuring customer satisfaction
Ukuthula is responsible for creating opportunities, not for the Client’s internal execution or outcomes.
6. ADVERTISING SPEND RESPONSIBILITY
6.1 Client Responsibility for Ad Spend
All advertising spend on platforms such as Google, Meta (Facebook and Instagram), and any other advertising platforms is the sole responsibility of the Client.
6.2 Direct Payment to Platforms
Advertising costs must be paid directly by the Client to the respective platform.
These costs are not included in Ukuthula’s service fees unless clearly agreed in writing.
6.3 No Financial Responsibility by Ukuthula
Ukuthula shall not be responsible or liable for:
Any advertising charges or spend
Failed or declined payments
Unexpected deductions by advertising platforms
Billing disputes with third-party platforms
6.4 No Guarantee of Advertising Performance
Ukuthula does not guarantee the performance of paid advertising campaigns.
Ukuthula shall not be held liable for:
Loss of advertising spend
Poor campaign performance
Low return on investment (ROI)
6.5 Client Obligation to Maintain Funding
The Client is solely responsible for ensuring that:
Sufficient funds are available in advertising accounts at all times
Payment methods are valid and active
Campaigns are not interrupted due to insufficient funds
The Client acknowledges that advertising platforms may automatically deduct funds at any time without prior notice.
6.6 No Responsibility for Campaign Interruptions
Ukuthula shall not be held responsible for:
Campaign interruptions
Loss of leads or opportunities
Reduced performance
Where such issues are caused by:
Insufficient funds
Payment failures
Platform billing actions
7. NO LIABILITY FOR BUSINESS PERFORMANCE
Ukuthula shall not be held liable for:
Poor sales performance
Lack of conversions
Business losses
Reputational damage
Missed opportunities
Where such outcomes are influenced by factors outside Ukuthula’s control.
8. EXTERNAL FACTORS
The Client acknowledges that results may be affected by:
Market conditions and economic factors
Industry competition
Platform algorithm changes (Google, Meta, etc.)
Advertising cost fluctuations
Seasonal demand variations
Ukuthula has no control over these external factors.
9. NO WARRANTY OF CONTINUOUS PERFORMANCE
Ukuthula does not guarantee that:
Campaign performance will remain consistent
Lead volume or cost per lead will remain stable
Platforms or systems will operate without interruption
10. ACCEPTANCE OF RISK
By engaging Ukuthula’s services, the Client acknowledges that:
Marketing involves inherent risk
Results cannot be guaranteed
Success depends on both Ukuthula’s efforts and the Client’s execution
